Litigation

The McHattie Law Firm represents a diverse group of clients in both state and federal courts, in mediations, arbitrations, and administrative proceedings, and proceedings before the Trademark Trial and Appeal Board (TTAB). Our attorneys focus on the end result, assessing the risks and rewards of litigation at the outset, with the goal of resolving disputes as efficiently and amicably as possible. We have represented clients in many fields, including business and commercial disputes, intellectual property, employment, contract and tort, competition and trade regulation, insurance, and tax and professional licensure matters, to name just a few.

Litigation can cause a number of impacts, both the immediate disruption and cost of litigation, not to mention the long-term impact resulting from a judgment. We work closely with our clients to ensure all factors are being assessed and reconsidered throughout litigation. Our first goal is to develop a strategy to avoid litigation, as the best litigation is the one that never happens.

However, if a dispute does arise, even if just a threat of litigation, the McHattie Law Firm is adept at getting those matters resolved (whether by way of a Demand or Cease and Desist Letter, or a filed litigation or formal dispute before the TTAB or a state or federal court). Our lawyers don’t just go through the motions; we think about what we’re doing and, in addition to getting the matter ready for trial, devise and implement strategies designed to obtain appropriate, efficient and pragmatic results.

Moreover, given the multi-level impact of any litigation on a business (whether the business regularly deals with litigation or not), we address the facts and issues of the dispute, as well as the broader implications to both the business and enterprise risk management. Our attorneys don’t merely look at the costs of litigation versus resolution, but also consider and provide counsel on the matter’s impact on other aspects of the business, such as long term implications, precedent, human resources, and regulatory implications and compliance. The goal is to solve a problem without creating two more.
